This site is operated by KinetiStack™ LLC (“KinetiStack,” “we,” “us”), a limited liability company organized in the State of Minnesota, USA. Terms of Use
1. Acceptance
By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the site.
2. The website and its content
This site provides information about KinetiStack and our product, KinetiShift. Content is provided for general informational purposes and may change or be updated at any time without notice. We aim for accuracy but do not warrant that all content is complete or current.
3. The software is separate
KinetiShift is pre-release evaluation software. Nothing on this website is an offer to license, sell, or deliver the software, and no statement here creates any warranty or commitment. Any access to or use of KinetiShift is governed exclusively by a separate written agreement executed between KinetiStack and the customer — the KinetiShift Pilot Agreement and applicable Order Form (or such other license agreement as the parties execute). In the event of any conflict, that executed agreement controls.
4. Intellectual property
The website, its content, and the KinetiShift software are owned by KinetiStack and protected by intellectual-property laws. “KinetiStack” and “KinetiShift” and associated logos are marks of KinetiStack™ LLC. You may not copy, reproduce, or create derivative works from the site or software except as expressly permitted in writing.
5. No warranties
The website is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of liability
To the fullest extent permitted by law, KinetiStack will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of this website. Terms governing the software itself, including any liability limits, are set out in the separate executed agreement (Section 3).
7. Third-party links
The site may link to third-party websites or resources. We are not responsible for their content, policies, or practices.
8. Governing law
These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Minnesota for any dispute relating to the website or these Terms.
9. Changes
We may update these Terms from time to time. The “Effective date” above shows when they were last changed; continued use of the site after a change means you accept the updated Terms.

Privacy
We keep this simple: we collect only what we need to respond to you, and we do not sell your information.
1. What we collect
- Information you submit — when you use a contact or “become a design partner” form, we collect what you provide (typically your name, work email, company, and message).
- Basic technical data — standard server logs and privacy-respecting analytics (for example, aggregate page views). We do not use these to build advertising profiles.
2. How we use it
To respond to your inquiry, to communicate with you about KinetiShift and possible pilot evaluations, and to operate and improve the site. We process this information because you asked us to contact you or because we have a legitimate interest in responding to your inquiry.
3. What we do NOT do
We do not sell, rent, or trade your personal information. We do not share it except with service providers who help us operate the site and communicate with you (for example, email or hosting providers), under confidentiality obligations, or where required by law.
4. Retention
We keep inquiry information for as long as needed to respond and to maintain our business records, then delete or anonymize it.
5. Your choices
You may ask us to access, correct, or delete the personal information you have given us, or to stop contacting you, by emailing privacy@kinetistack.co. We will honor valid requests as required by applicable law.
6. Security
We use reasonable administrative and technical measures to protect the information we hold. No method of transmission or storage is perfectly secure, but we take care to safeguard your data.
7. International visitors
We are based in the United States; if you contact us from outside the US, your information will be processed in the US.

We may update this Privacy section; the “Effective date” above reflects the latest version.
